Buh-bye fair use sampling

Wired News is reporting that a federal appeals court has ruled that “artists should pay for every musical sample included in their work — even minor, unrecognizable snippets of music.” Previously, “it has been legal to use musical snippets — a note here, a chord there — as long as it wasn’t identifiable.”

The “minor, unrecognizable” part kills me! I would argue that all music is derived and inspired by other music. Art does not exist in a vacuum and rulings like these serve no purpose other than to discourage creativity.

In short, I think it’s bullshit. And it certainly says a lot about the legality of what’s coming out of the remix and bastard pop community. These sorts of grey musical arts are now a dark shade of black.
